Appeal Court Sacks Two Federal Lawmakers In Imo
An Appeal Court in Owerri, Imo State sacked two federal lawmakers on Saturday.
The two lawmakers, Obinna Onwubuariri representing Isiala Mbano/Onuimo/Okigwe Federal constituency and Mrs Uju Onwudiwe representing Njaba State Constituency.
While Onwubuariri contested on the platform of the Peoples Democratic Party (PDP), Onwudiwe ran on Action Alliance.
The Chairman of the Panel, Justice R.N Pemu read the judgement in the PDP’s lawmaker’s case. Pemu said the election that brought the PDP candidate to power was not done in tandem with the 2010 electoral act as amended.
The appelate court repeated the judgement of the lower court by ordering a fresh election within 90 days.
The court said the candidate of the All Progressives Congress (APC) Pemu said the petitioner, Miriam Onuoha proved her case of over-voting, mutilation of figures and violence which marred the election
NAN had earlier report the sacking of Onwubuariri who appealed her case at the appellate court after it had reached a similar judgement.
The court ordered the Independent National Electoral Commission (INEC) to conduct a fresh election for the duo within 90 days and withdraw the certificate of return it had earlier issued.
Mr Charles Abia, the PDP candidate had challenged Onwudiwe’s victory in the court of appeal
